Criterion 3 and transient spaces

Ive a transient space. Defined as a circulation area. According to Para4.44d of Part L2A these should be excluded. However it is still assessing the space and failing it. Its a foyer/lobby with a glazed part of its roof. This area should not be being considered amongst the checks. Whassup?

Is the space cooled? In accordance with the 2010 NCM modelling guide, ApacheSim Compliance only performs Criterion 3 check on applicable rooms, i.e it will only report results for rooms that are occupied or mechanically cooled.
